IMPORTANT NOTICE: These Booking Conditions set out the terms of the contract between you and the Organiser. By making a booking, you agree on behalf of all persons named on the booking that you have read, understand, and agree to be bound by these Terms and Conditions.
## 1. DEFINITIONS AND ROLE OF THE ORGANISER
| Term | Definition |
| The Traveller (You) | The first named person on the booking who is responsible for all payments and decisions on behalf of all other persons named. |
| The Package | The combination of at least two different travel services (e.g., accommodation, transport, tourist services) sold by us for the purpose of the same trip. |
| Supplier | The third party provider of the individual components of the Package (e.g., Las Torres, BusBud, etc.). |
| The Organizer | [Your Company Legal Name], which is legally defined as the organiser of the Package and is responsible for its proper performance. |
| Force Majeure | Any event which we or the Supplier could not, even with all due care, foresee or avoid (e.g., war, natural disasters, pandemic-related government closure, etc.). |
## 2. BOOKING, CONFIRMATION, AND PAYMENT
### 2.1 Formation of Contract
A binding contract is formed between the Traveller and the Organizer once (a) the Organizer issues a written confirmation invoice and (b) the required deposit has been received by the Organizer.
### 2.2 Payment Schedule
* Deposit: A non-refundable deposit of £50 is due at the time of booking. Only refundable if booking options sell out between deposit payment and attempting booking.
* Final Balance: The final balance is due within 48 hours of the booking completion. A 1% fee will be added for each 48 hours after the 48 hour cutoff.
### 2.3 Consequences of Non-Payment
If the final balance is not received by 2 weeks after booking confirmation, the Organizer reserves the right to treat the booking as cancelled by the Traveller, and the cancellation charges outlined in Section 4.1 will apply.
## 3. PRICE AND SURCHARGES
### 3.1 Price Guarantee
The price of your Package is guaranteed from the date of the confirmation invoice, subject to corrections of errors and the exceptions below.
### 3.2 Price Changes and Surcharges
The Organizer reserves the right to increase the price of the confirmed Package only in the event of changes in:
1. The price of the carriage of passengers resulting from the cost of fuel or other power sources.
2. The level of taxes or fees on the travel services included in the contract imposed by third parties not directly involved in the performance of the Package (e.g., tourist taxes, embarkation/disembarkation fees).
3. The exchange rates relevant to the Package.
If the price increase exceeds 8% of the total Package price, the Traveller may terminate the contract and receive a full refund of all payments made, or accept an alternative Package.
## 4. CANCELLATION AND REFUND POLICY
### 4.1 Cancellation by the Traveller
All cancellation requests must be made in writing by the lead Traveller to the Organizer’s email address: info@torrestreks.com. The effective cancellation date is the date the written notification is received by the Organiser.
The following cancellation charges, based on the total Package price, apply (excluding the non-refundable deposit):

***Note on Refunds:*** Refunds are calculated based on the above schedule minus any non-recoverable costs already paid to third-party Suppliers. The specific policies of each Supplier (detailed in 4.2) will dictate the final non-recoverable costs.
### 4.2 Specific Supplier Refund Schedules
#### A. Accommodation: Las Torres Patagonia (Seron, Francés, Cuernos, Chileno, Central)
Due to the high demand and specific contract terms for the "O" and "W" circuitsaccommodation suppliers generally impose strict cancellation policies.

#### B. Accommodation: Vertice Patagonia (Dickson, Los Perros, Grey, Paine Grande)
Due to the high demand and specific contract terms for the "O" and "W" circuits, accommodation suppliers generally impose strict cancellation policies.

#### C. Transport: BusBud (Bus Tickets)
Bus tickets are often non-refundable, particularly closer to the departure date.

#### D. Tourist Service: Lago Pehoe Catamaran
This service is typically required to be paid in full well in advance.

### 4.3 Force Majeure
Except where otherwise stated in these Booking Conditions, we regret that neither we nor the Supplier can accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by Force Majeure.
## 5. THE ORGANISER'S LIABILITY
### 5.1 Responsibility for Package Performance
As the Organiser of the Package, we accept responsibility for the proper performance of all travel services included in the Package, irrespective of whether those services are to be performed by us or by the Suppliers.
### 5.2 Assistance to the Traveller
If the Traveller is in difficulty during the Package, we will provide appropriate assistance without undue delay, particularly in the event of Force Majeure. We may charge a reasonable fee for such assistance if the difficulty is caused intentionally by the Traveller or through their negligence.
### 5.3 Limitations of Liability
Our liability to you will be limited in accordance with the international conventions which govern the services provided. In all other cases, our liability for claims that do not involve death, personal injury, or loss of possessions will be limited to a maximum of three times the cost of the Package.
## 6. TRAVEL INSURANCE AND DOCUMENTATION
### 6.1 Travel Insurance (Mandatory)
It is a mandatory condition of booking that all Travellers are protected by an adequate and valid travel insurance policy from the date of booking. The policy must cover cancellation and amendment charges, medical expenses (including repatriation/evacuation), and loss of luggage/money.
### 6.2 Traveller Documentation
The Traveller is responsible for ensuring that all members of the party possess the correct passports, visas, and health documentation required for entry to Chile and the Torres del Paine National Park, including any specific COVID-19 related requirements or fees. The Organizer accepts no responsibility for any delay or expense incurred through the non-fulfilment of these requirements.
## 7. AMENDMENTS BY THE TRAVELLER
If the Traveller wishes to make changes to the confirmed Package (e.g., change of date, accommodation type), they must notify the Organizer in writing.
* The Organizer will try to accommodate the change but cannot guarantee it.
* An administrative fee of £20 per person will be charged for any accepted change, plus any additional costs or charges imposed by the relevant Suppliers.
* Changes within 60 days of the start date are often treated as a cancellation and re-booking.
## 8. COMPLAINTS AND GOVERNING LAW
### 8.1 Complaints Procedure
If you have a complaint during your Package, you must inform the relevant Supplier (e.g., hotel manager, bus driver) and to info@torrestreks.com immediately so that the issue can be resolved. If the complaint remains unresolved, you must notify the Organizer in writing within 28 days of your return from the Package.
### 8.2 Governing Law
This contract, and any dispute arising out of it, shall be governed by the laws of England and Wales.
