IMPORTANT NOTICE: By making a booking, you agree on behalf of all persons named that you have read and agree to these Terms and Conditions.

1. DEFINITIONS

The Traveller (You): The lead person responsible for all payments and decisions for the booking.
The Package: A combination of at least two travel services (e.g., accommodation and transport) sold as one trip.
The Organiser: Torres Treks Ltd, legally responsible for the proper performance of the Package.
Unavoidable and Extraordinary Circumstances: (Force Majeure) Any event beyond our or our suppliers' control, the consequences of which could not have been avoided even if all reasonable measures had been taken (e.g., natural disasters, trail closures, war, pandemics).

2. FINANCIAL PROTECTION (PTS) (In Progress)

Torres Treks Ltd is a member of Protected Trust Services (PTS). 100% of your money is held in an independent trust account and is only released to pay suppliers or to us once all supplier payments have been made. This ensures you are fully protected against our insolvency.

3. BOOKING, PAYMENT & SURCHARGES

3.1 Formation of Contract: A contract exists once we issue a confirmation invoice and receive your deposit.
3.2 Payment Schedule: Refer to Unique T&C’s provided on your specific itinerary page; those terms override this section in the event of inconsistency. Unless otherwise stated in your Unique Terms: A non-refundable deposit of 20% is due at booking. The final balance is due 70 days before departure. If booking within 69 days, full payment is required immediately.
3.3 Surcharges: We reserve the right to change prices due to fuel costs, taxes, or exchange rates. If the increase exceeds 8%, you may cancel with a full refund.

4. CANCELLATIONS & REFUNDS

4.1 Cancellation by the Traveller: You must notify us in writing. Refund schedules and non-refundable deposits are unique to each route. You must refer to the "Unique Terms & Conditions" provided on your specific itinerary page; those terms override this section in the event of inconsistency.
4.2 General Cancellation Charges: Unless otherwise stated in your Unique Terms, the following charges apply:
- 90+ Days: Forfeit of Deposit Only.
- 89–70 Days: 20% of total cost.
- 69–45 Days: 50% of total cost.
- 44 Days or less: 100% of total cost.
4.3 Force Majeure: Under the Package Travel Regulations 2018, you may cancel without fee if Unavoidable and Extraordinary Circumstances at the destination significantly affect the trip. You will receive a full refund of money paid to Torres Treks Ltd via the PTS Trust Account. We are not liable for consequential losses (e.g., independent flights or gear).
4.4 Processing: Refunds are processed via PTS within (need to ask) days.

5. THE ORGANISER’S LIABILITY

5.1 Performance: We accept responsibility for the proper performance of all services in the Package.
5.2 Limitation: Our liability for claims (excluding death or injury) is limited to a maximum of three times the cost of the Package.

6. TRAVEL INSURANCE & DOCUMENTATION

6.1 Mandatory Insurance: All Travellers must have valid insurance from the date of booking covering medical evacuation/repatriation and cancellation.
6.2 Documentation: You are responsible for all passports, visas, and health entry requirements.

7. ADVENTURE TRAVEL & SAFETY (BS 8848)

7.1 Acknowledgement of Risk: You acknowledge that trekking in remote environments involves inherent risks, including extreme weather and limited medical access.
7.2 Fitness: Per BS 8848, you must ensure your party has the required fitness. You must disclose pre-existing medical conditions.
7.3 Itinerary Flexibility: Due to the "rugged" nature of our trips, we reserve the right to make minor changes (e.g., altering a campsite due to high winds) without this being a significant change to the contract. No refunds are issued for environmental factors outside our control.

8. COMPLAINTS & LAW

8.1 Procedure: If you have a complaint, you must inform the supplier and info@torrestreks.com immediately. Formal complaints must be sent in writing within 28 days of your return.
8.2 Governing Law: This contract is governed by the laws of England and Wales.
